- Supreme Court Justice Samuel Alito is facing growing calls to recuse himself from Jan. 6-related cases after a bombshell report of an upside-down American flag flying on his lawn house shortly after the attack on the Capitol, which he claimed his wife did as part of a spat with an anti-Trump neighbor. Jennifer Rubin and Elie Mystal join Ali Velshi to discuss what the next steps should be and why Alito’s actions are not surprising. “They’ve already told you what they’re about. They’ve already told you that they’re MAGA-aligned pro-Trump insurrectionists and the proof of all that is not actually in the flag story or the email story, it’s in their written opinions,” Mystal says. “It’s in what they’ve done for Trump since he launched his insurrection, which is do everything in their Supreme power possible to make sure Trump evades prosecution and accountability for his crimes.”

He was just interpreting the law. Sadly, the Roe decision was against the law all these years and no ONE ever brought it up even though legal scholars are well aware . Now it’s in the hands of each state . Another thing has changed, now infants live and can actually be normal little children at 20 weeks gestation. So the public sentiment changed because to abort a child when they could be viable doesn’t sit well with anyone. It’s a new era, with medical advances , so now we can build a law that is actually legal.

You’re absolutely wrong. Read the Constitution which outlines the duties of a Justice. You will also note that the Supreme Court is the only court that is mentioned in the constitution. Supreme Court justices serve for life with good behavior. Nowhere in the constitution does the Supreme Court have the authority to determine if a law passed by elected representatives of the people is constitutional or unconstitutional. So, how did the Supreme Court take on this responsibility. You have the opportunity now to become a legal scholar.

This is totally wrong. Elections for judges would produce the same effects only more so - and they'd be constantly adjusting their interpretation of the law with one eye on their need for re-election. What chance would there be for justice if a judge is to be chosen by the people that put specimens like MTG and Gaetz in office?
Judges must be above politics - meaning they should not be in a position where it benefits them to kow-tow to either politicians or the electorate. They should be selected by experienced members of the legal profession and both they themselves AND the selectors must have publicly available records displaying their professional expertise fitness for office. Fixed terms if you like but I wish just one of the many fans of fixed terms would explain how fixed terms would prevent ANY of the current shenanigans coming from SCOTUS, Aileen Cannon etc. Fix the term for just one year and they can still do massive damage if they are biased or corrupt.

Not really. Any SCOTUS justice can write a concurring or dissenting opinion on any decision they make. So John has no way to silence Sam or Clarence or any other member of the Court, contrary to what the commentators are saying.
